This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) (a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Rule 4 of the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal data or Information) Rules, 2011 framed under the (Indian) Information Technology Act, 2000 (as amended from time to time) that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.compliansia.com Platform.

The online platform – www.compliansia.com (“Website”), is owned and operated by COMPLIANSIA TAX INNOVATORS LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008 with its registered office at H.P. College Road, Ismile, Asansol, Bardhaman, West Bengal -713301 (“COMPLIANSIA”, “We”, “Our”. “Us”). The Website its sub-domains and other sites/ apps/ other channels including any mobile applications maintained by COMPLIANSIA to enable the Services shall be collectively referred to hereinafter as the (“Platform”). The products and services provided by COMPLIANSIA through the Platform shall be referred as (“Services”).

The words “Customer”, “User”, “You” and “Your” refer to the person(s) who use and avail the Services provided by COMPLIANSIA through the Platform and shall include both singular and plural. The Services provided herein is only for the Indian citizens and tax resident of India.

COMPLIANSIA is concerned about the privacy of its Users and their privacy is very important for Us. This Privacy policy governs the manner in which, we collect and use, disclose and protect Your Personal Information.

“Personal Information” for the purposes of this Privacy Policy shall include, but not be limited to, information regarding User’s name, address, telephone number, date of birth, gender, e-mail address, computer sign-in data, statistics on page views, traffic to and from COMPLIANSIA and Ad data (all through cookies – You can take steps to disable the cookies on Your browser although this is likely to affect Your ability to use the site), Users IP address and standard web log information.

This Privacy Policy governs the manner in which COMPLIANSIA collects, uses, maintains and discloses information collected from the Users. This Privacy Policy applies to the site and to the other products and services offered by COMPLIANSIA.

1. Privacy of Customer Data

COMPLIANSIA understands the value of Your financial information and any information within the domain of COMPLIANSIA is treated as strictly confidential and COMPLIANSIA does not and will not disclose or share such confidential information to/with any external organization.
COMPLIANSIA does not share its User’s Personal Information with another Company, organization or individual. You may trust Us as everything is kept safe and secure with Us and none of the Personal Information provided by You will be shared to another by Us, except as provided under this Privacy Policy.
We are governed by the provisions of applicable law in India including the Information Technology Act 2000 and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 to maintain the privacy of your Personal Information (including sensitive personal information).

2. Extent of Liability of COMPLIANSIA

COMPLIANSIA is not responsible for any breach of security or for any actions of any third parties that receive Your Personal Information.
COMPLIANSIA is concerned and values Your Personal Information and privacy. However, notwithstanding anything contained in this Privacy Policy or elsewhere, COMPLIANSIA shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).
A “Force Majeure Event” shall mean any event that is beyond the reasonable control of COMPLIANSIA and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, inevitable accidents, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, system hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.
COMPLIANSIA will take reasonable steps to protect that information from misuse and loss and from unauthorized access, modification or disclosure.

3. Information COMPLIANSIA collects and uses

    1. When You visit Our Platform, You are not required to provide any Personal Information unless You choose to avail Our online services or sign up for Our blog or free newsletter or other services which are described below. For availing Our online services, you hereby consent to the collection, use, storage, disclosure and otherwise processing of your information (including sensitive personal information) on the Platform in accordance with this Privacy Policy. If you disclose to us any Personal Information (including sensitive personal information) relating to other person, you represent that you have the authority and consent from the other person to do so and to permit us to use such Personal Information (including sensitive personal information) provided in accordance with this Privacy Policy.
    2. Blog and Newsletters: When You subscribe to Our blog or newsletters we collect Your email address to e- mail You the newsletters. If at any time You wish to limit the communication You receive from COMPLIANSIA, You can click on the “Unsubscribe” link or follow the instruction in each of promotional or marketing e-mail message.
    3. Availing a Service related to Tax return filing and other related service- When availing services of COMPLIANSIA for filing return, advisory or any other service, certain information; such as Your name, address, email address, phone number, permanent account number (“PAN”), bank account number, IFSC Code, income and deductions data, expenses data, asset and income details, vouchers, bank statements, form 16/ form 16A, tax payment challans, debit and credit account numbers and its expiration and any other information as may be required to prepare Your tax return is required to be shared by You; all the information provided are critical and required at the time of filing any income tax return.This information is collected for preparation and filing of Your Income Tax Return, to complete the payment transaction, customer service purposes, marketing communication with You, both online and offline.
    4. Registration: In order to avail Our tax preparation and income tax return filing services You must register Yourself on the Website and You must provide Your contact number, email address, a password. At the time of registration COMPLIANSIA requires Your e-mail id, contact details which helps in communicating the ITR acknowledgements, client’s refund status, any further notices, Your work status and related details etc. which may be required in future for various critical reasons.This information is collected for personal identification, to provide the tax preparation services, to allow Us to contact You for customer service purpose, to sendYou the tax update, newsletter and for marketing communication with You, both online and offline.
    5. COMPLIANSIA may collect information of the viewed pages, links, actions taken using the standard information that browsers send to each website You use such as IP address, browser type, and the previously visited web pages. All the information is used by COMPLIANSIA only to improve and enhance the return filing experience.
    6. Towards the commitment of quality and for the better experience of the User, we record the journey of tax filing of the User. This activity is solely restricted to understand the User behaviour so that we can improve the product and simplify the process..
    7. At the time of registering with COMPLIANSIA, the Platform will ask You for Personal Information such as Your name, email address, birth date, pin code, occupation and industry. Once You register with COMPLIANSIA and sign in to the services, You are not anonymous to COMPLIANSIA.
    8. COMPLIANSIA will only collect, store, use, and share Your Personal Information as it is defined under this Privacy Policy and as regulated by Indian laws. When filing a tax return online, in addition to entering Your own Personal Information, You may be asked to enter Personal Information of those who are either dependents or persons for whose income You are liable.
    9. Only information provided by You is stored by COMPLIANSIA. COMPLIANSIA does not supplement Your information with information from other companies. The exception to this would be when Your employer has bought the services/products for bulk use for its employees and to facilitate that We may upload information provided by Your employer.
    10. When You use calculators and other tools on the Platform that may or may not require registration, COMPLIANSIA may collect non-identifiable data from such tools, to help customize offers and tools to Your particular interests. COMPLIANSIA will not record or track any data You enter into standalone tools and calculators in any way that identifies You personally, unless We specifically inform You that We are doing so at the time You provide such data.
    11. In case You avail any other services of COMPLIANSIA wherein COMPLIANSIA is required to access Your form 16 either in physical or electronic form provided to COMPLIANSIA either physically through post, courier or any other mode or by email, it is presumed that You have read this Privacy Policy and has authorized COMPLIANSIA to access such information as is required for the service sought.
    12. You agree and authorize COMPLIANSIA to save Your income tax platform user id and password and, accordingly, COMPLIANSIA can use Your income tax platform account and other related accounts to provide You services and for research purpose.
    13. COMPLIANSIA uses Your information for the following general purposes: to customize the advertising and content You see, fulfill Your requests for provision of products and services, improve Our services, contact you, conduct research, and provide anonymous reporting for internal and external clients. COMPLIANSIA reserves the right to make use of the Personal Information in any investigation or judicial process relating to fraud on account of such transactions during the period when COMPLIANSIA retains such information.
    14. COMPLIANSIA reserves the right to track the information which is deleted from the Platform after when the investigation under any law has been initiated.
    15. COMPLIANSIA do not and shall not at any point in time, either sell or rent Users’ Personal Information to third parties without Users’ explicit consent.
    16. COMPLIANSIA uses Personal Information to protect the integrity of the Platform.
    17. We analyze Your Personal Information to learn about the use of COMPLIANSIA products and services to help Us develop new products and services. We retain copies of Your completed and filed tax returns in accordance with COMPLIANSIA’s records and information management policy, subject to this Privacy Policy.

4. DISCLOSURE AND TRANSFER OF PERSONAL INFORMATION

    1. Under no circumstances, COMPLIANSIA will sell, distribute, trade, lease or rent Your Personal Information to anyone, for any reason(s). Also, we may provide aggregate statistics about Our Customers, sales, traffic patterns, and related website information to reputable third-party vendors, but these statistics will, in no way, include Your personally identifying information.
    2. All employees of COMPLIANSIA have been selected in accordance with Our strict security policies and practices and are bound by confidentiality obligations. COMPLIANSIA employees are subject to stern disciplinary action, including termination, civil liability, and criminal prosecution, if they fail to meet any of these obligations, as stated.
    3. COMPLIANSIA may also use third party vendors or personnel or service providers to provide services and/or to enableUs provide Services to You, such as couriering documents to You on Our behalf or operating the payment gateway functionality of the Platform etc… Such third parties are required to maintain the confidentiality of the information We provide to them under specific agreements which we have entered with them and under applicable laws.
    4. We may share Personal Information, with government agencies or law enforcing agencies or Our regulators as mandated under law to obtain information including sensitive Personal Information or Personal Information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences, or to protect the interests of COMPLIANSIA and/or any particular User(s), but We will only do so under proper authority and wherever possible with the User’s consent. You authorize Us to disclose Your Personal Information in such cases. Notwithstanding anything contained in this Privacy Policy, any Sensitive Personal Information or Personal Information shall be disclosed to any third party by an order under the law for the time being in force.
    5. COMPLIANSIA may transfer Personal Information, to any other body corporate or a person, provided that such transfer is necessary for the performance of a lawful contract between COMPLIANSIA and the User or where the User has consented to such transfer.
    6. Further, COMPLIANSIA shall ensure that such body corporate or person adheres, to whom the transfer of data takes place, adheres to the same level of data protection as mandated under applicable laws.
    7. We may share Personal Information with Ourgroup companies and affiliates. These group companies and affiliates may market to You as a result of such sharing unless You explicitly opt-out by notifying Us in writing.
    8. We and Our group companies and affiliates will share / sell some or all of Your Personal Information with another business entity should We plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to comply with the terms agreed under this Privacy Policy with respect to Your Personal Information.

COMPLIANSIA works to protect Your Personal Information including Your tax return information from loss, misuse or unauthorized alteration by using industryrecognized security safeguards, coupled with carefully developed security procedures and practices. COMPLIANSIA maintains electronic and procedural safeguards of all tax return information and uses both internal and external resources to review its security procedures. COMPLIANSIA whenever requires transmitting of sensitive information, such as tax return or credit card information, it is supported by encryption of all the information transmitted to Us. We work to protect the security of your information as per the International Standard ISO/IEC 27001 on “Information Technology Security Techniques Information Security Management System-Requirements”

6. Customer Testimonials and Comments

We post customer testimonials and comments on Our Platform, which may contain Personal Information. We post this information only when receiving this from the customer over mail or on Our social media pages and You hereby consent to the same.

7. Cookies

To enhance Your experience with Our Platform, many of Our web pages use “cookies” and client ID’s. Cookies are text files we place in Your computer’s browser to store Your preferences. Cookies, by themselves, do not reveal Us Your e-mail address or other Personal Information unless You choose to provide this information to Us. However, once You choose to furnish Us with personally identifiable information, this information may be linked to the data stored in the cookie.

8. Withdrawal of Consent

You may decide to withdraw Your consent provided to Us under this Policy at any point in time. Such withdrawal of consent must be sent in writing to support@compliansia.com. In such a scenario, We shall delete Your Personal Information (including sensitive personal information) or de-identify it so that it is anonymous and not attributable to You.

9. Access to Your Information

You can access your information in the “My Account” section on the Platform. To request access to information provided by You, that is not available through My Account section, You can submit a request in writing to support@compliansia.com.

10. Others

Our Website may provide links to other websites. We will not control and not responsible for, the content or practices of those other this parties and their platforms. You hereby confirm that You understand and agree that, this Privacy Policy does not apply to these other platforms, which are subject to any privacy and other policies they may have.
We offer publicly accessible message boards, blogs, and community forums. You herebyconfirm that You understand and agree that, if You directly disclose any information through Our public message boards, blogs, or forums, this information may be collected and used by others. We will correct or delete any information You have posted on the Websites if You so request in writing to Us.
You hereby agree to provide the details of taxes paid, income and all relevant information as per appearing the Form26/AIS/TIS. In case of any mismatch, You hereby agree to notify the same to the COMPLIANSIA.
It is your responsibility to share the details of Form26AS, to enable Us to file the tax accurately, if there were any errors and if any subsequent claims are raised which are not attributable to COMPLIANSIA, it is hereby clarified that COMPLIANSIA shall not be responsible in any manner whatsoever.

11. Changes to this Privacy Policy

This Privacy Policy may change from time to time. COMPLIANSIA will not reduce your rights under this Privacy Policy without your explicit consent. COMPLIANSIA will post any Privacy Policy changes on this page and We will provide a prominent notice (ie. email or popup or similar notification) and the changes will become effectiveon a going-forward basis with respect to Your continued use of the Platform or availing the Services or when a payment transaction is initiated by You through the Platform. If You do not agree with any such change, Your sole and exclusive remedy is to terminate Your use of the Platform and the Service. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the Changes.

In addition to the foregoing, any disputes arising under this Privacy Policy shall be governed by the Arbitration and Conciliation Act, 1996. The same shall be subject to the jurisdiction of the Courts at Asansol.
